This website is operated by Creality 3D Technology (Europe) GmbH (hereinafter “Nexbie”, “we”, “us” or “our”). Nexbie is a brand operated by Creality 3D Technology (Europe) GmbH. The online shop is accessible at de.nexbie.com.

We offer this website on the condition that you, as a user, accept all terms, policies and notices set out herein. By using our website and/or purchasing products, you agree to our services and accept these General Terms and Conditions (“GTC”), including all additional terms referred to herein. These GTC apply to all users of the website.

Please read these GTC carefully before using our website. By using the website, you agree to these terms. If you do not agree to all terms, you may not use the website.

You can view the current version of the GTC on this page at any time. We reserve the right to adjust these GTC for the future where this becomes necessary for legal, regulatory or operational reasons. We will notify you of material changes in good time in text form. For orders already completed, the GTC valid at the time of the order shall always apply.

II. Important Notice for Customers

Before placing your order, we strongly recommend that you review the following terms.

1. Safety Commitment Nexbie prioritises the protection of human life. With each purchase, you confirm that the products will not be used directly or indirectly to endanger health or safety. You undertake to comply with applicable safety standards and ethical norms.

2. Legal Compliance Nexbie always acts in compliance with the law in all relevant jurisdictions. You undertake to comply with all local, national and international laws.

3. Confirmation By placing an order, you confirm that you have read, understood and accepted these terms.

III. Products and Descriptions

We sell 3D-printed shoes as standard products. These are not goods individually manufactured to customer specifications within the meaning of Section 312g (2) no. 1 BGB (German Civil Code); the statutory right of withdrawal therefore applies to you without restriction.

We endeavour to reproduce the colours and images of the products shown in the shop as accurately as possible. However, we cannot guarantee that the colour display on your screen corresponds exactly to the actual product colour, as this depends on your screen settings.

Quantity limits per order as well as regional delivery or availability restrictions are possible and will be displayed on the respective product page where applicable.

IV. Order and Payment Terms

The prices stated in the online shop at the time of the order apply. All prices are final prices in euros, inclusive of tax.

Product prices include the applicable statutory value-added tax (VAT) of the destination country. As VAT rates vary between delivery countries, the final price inclusive of VAT may differ depending on your delivery address. The final tax-inclusive price applicable to your order will be displayed during the checkout process, before you confirm your order, based on your delivery address.

No shipping costs are charged for deliveries within the delivery area (see Section V and our Shipping Policy). We reserve the right to adjust prices for future orders at any time. For contracts already concluded, the price agreed at the time of the order remains binding.

Order Confirmation and Acceptance The information displayed on the Nexbie Official Store constitutes merely an invitation to negotiate and does not constitute an offer by us to provide products or services. By placing an order on the Nexbie Official Store, you represent and warrant that you have full legal capacity to agree to these terms and conditions and to enter into a binding purchase agreement.

  • Order: The order you submit through the Nexbie Official Store is subject to acceptance by Nexbie to become effective. Nexbie reserves the right to reject all or part of any order at any time before shipment or delivery. Reasons for rejecting an order include, but are not limited to, credit card rejection, product or service unavailability, and/or the ordered quantity of products or services being abnormally large or excessive. Acceptance of any order is independent of other orders. Prices may change due to material or resource shortages, increased manufacturing costs, or other factors until we accept your order.

  • Email Confirmation: After receiving your order and payment, we will send you a confirmation email. Your order will only be deemed accepted by Nexbie when you receive the order confirmation email from Nexbie. Before accepting or processing your order, Nexbie may request additional information from you. If any information in the confirmation email is incorrect, please notify Nexbie immediately.

  • Order Confirmation Email: Once we accept your order and are ready to ship, we will send you an order confirmation email containing shipping details. For out-of-stock items, we will send you a further order confirmation email when the items arrive and are ready to ship. You may cancel an order that has not yet been shipped from our warehouse. You can log into your Nexbie account to track the logistics status of your order. If we are unable to deliver the products you ordered after confirming your order, we will cancel the order and issue a refund to you. Refunds will be processed within 14 days of cancellation, in accordance with the statutory requirements.

Payment Methods The following payment methods are available to you in our online shop:

  • Credit cards: Visa, Maestro, Mastercard, American Express, UnionPay

  • PayPal

  • Klarna

Payment is processed via Shopify Payments and PayPal. Which payment methods are available in the individual case will be shown to you at checkout before completion of the order. We reserve the right not to offer individual payment methods or to offer them only after a successful credit check.

V. Delivery and Delivery Time

We currently ship to most EU countries (17 countries in total, excluding Bulgaria, Croatia, Cyprus, Greece, Hungary, Ireland, Malta, Romania, Slovakia, and Slovenia). Delivery is not available to remote areas or affiliated islands. If your address falls into these restricted areas, you will not be able to complete the checkout process.

Delivery is free of shipping costs within the entire delivery area. The expected delivery times consist of:

  • Processing time: As a rule within 3 working days of conclusion of the contract (or, in the case of advance payment, from receipt of payment). During this time, your order is picked and handed over to the shipping service provider.

  • Shipping time: 1 to 15 working days from handover to the shipping service provider.

Unless otherwise stated, the total delivery time is therefore generally 4 to 18 working days. Any deviating delivery times will be shown to you before placing the order on the product page or during the ordering process.

If an ordered product is not available, we will inform you immediately. In this case, payments already made will be refunded promptly. Further information on shipping, shipment tracking and delivery conditions can be found in our separate Shipping Policy.

VI. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 BGB).

Essential Content of the Right of Withdrawal in Brief

  • Withdrawal period: 14 days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

  • Form of withdrawal: Clear declaration (e.g. a letter sent by post or e-mail to contact@nexbie.com).

  • Refund: We will refund all payments received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within 14 days of receipt of your withdrawal.

  • Return costs: Return shipping costs are governed by our Return Policy. In general, you bear the return costs for personal-reason returns; we bear the costs in the case of defective goods or transit damage (subject to supporting documentation). Please refer to our Return Policy for full details, including the reimbursement cap for self-arranged return shipping.

Voluntary Extended Return (30 Calendar Days) In addition to the statutory right of withdrawal, we grant you a voluntary extended right of return of 30 calendar days from receipt of the goods. The conditions of this voluntary return (in particular the requirement that the goods have not been used beyond what is necessary for inspection) are governed by our Return Policy.

The statutory right of withdrawal remains unaffected by the voluntary extended return and continues to exist in full.

VII. Warranty and Defect Rights

The statutory defect rights apply.

In the event of a non-human product defect, you are initially entitled to subsequent performance, i.e. to elimination of the defect (rectification) or delivery of a defect-free item (replacement delivery) at your choice. If the subsequent performance fails, is unreasonable or we refuse it, you may, in accordance with the statutory provisions, withdraw from the contract, reduce the purchase price or claim damages or reimbursement of futile expenses.

You can address complaints about defects to contact@nexbie.com. Please describe the defect as precisely as possible and, if possible, attach photos. This serves solely to simplify processing and does not restrict your statutory rights.

VIII. Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

IX. Rules for Use of the Online Shop

You may not use our products and our website for illegal purposes or in violation of applicable law (including copyright). The transmission of malicious software is prohibited. Violations may lead to immediate blocking of access.

X. General Conditions

For objective reasons, in particular in the case of suspected misuse, we reserve the right to refuse services.

The transmission of your content (except payment data) may take place unencrypted over open networks. Payment data is always transmitted encrypted.

The reproduction or commercial use of our content and services without our permission is prohibited. Headings in these GTC serve solely for clarity and do not affect the interpretation of the terms.

XI. Currency of Information

The website content, insofar as it is not part of binding contractual components, serves only for general information. We endeavour to provide current and correct content but cannot guarantee its continued completeness or accuracy. Binding are the details shown to you in the specific ordering process.

XII. External Tools

Third-party tools that we provide or integrate on our website are provided “as is”. The use of such tools is at your own risk, insofar as this is legally permissible.

XIII. External Links

Our website may contain links to third-party websites. We assume no liability for the content of these external pages. Please review the terms and privacy policies of external providers independently.

XIV. User Content and Comments

If you post content on our website (e.g. product reviews, comments, photos), you guarantee that this content does not infringe the rights of third parties, in particular no copyright, trademark or personality rights. You grant us the simple, temporally and spatially unlimited, free right to use, reproduce and publish this content in connection with the operation of our website.

We reserve the right to modify or remove content that violates applicable law or these GTC.

XV. Data Protection

The processing of your personal data takes place in accordance with our Privacy Policy, which can be accessed on the corresponding page of our online shop.

XVI. Errors and Omissions

Should there be obvious errors in our product information, prices or descriptions, we reserve the right to correct these and adjust affected orders accordingly or, if this would be unreasonable, to withdraw from the contract. In such a case, payments already made will be refunded promptly.

XVII. Prohibited Use

The misuse of our website is prohibited. In particular, you are prohibited from using the website for the following purposes:

  • For unlawful activities;

  • To infringe intellectual property (e.g. copyright, trademark law);

  • To distribute malicious software or to impair the functionality of our systems;

  • For harassment, discrimination or other unlawful behaviour towards other users or our employees.

XVIII. Indemnification

Use is at your own risk. We are not liable for indirect damages, insofar as legally permissible.

XIX. Severability Clause

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected thereby. The invalid provisions shall be replaced by the statutory provisions.

XX. Termination of Contract

Rights and obligations arising before termination of the contractual relationship remain in force. We may extraordinarily terminate the contractual relationship in the event of serious violations of these GTC in accordance with the statutory provisions. The consumer’s statutory right of withdrawal (see Section VI) remains unaffected by this.

XXI. Changes to These GTC

You can find the current version of these GTC on this page at any time. We reserve the right to adjust these GTC for future orders. For contracts already concluded, the GTC in the version valid at the time of conclusion of the contract shall always apply.
